Introduction

We are a company incorporated under Companies Act 1965 in Malaysia.

 

This Notice is given to you under Section 7 of PDPA as :

  • you are Our Customer; and/or

  • you are Our Business Associates.

It is given to you by us in relation to Personal Data collected, held or processed by us.

 

We will or may (or have done so), in that connection, collect and maintain certain information about yourself. Information, which is Personal Data, is regulated by PDPA.

 

This Notice is to help you understand when and why we collect information about you, the type of information we collect, the third parties to whom we may disclose such information and some of your rights and choices and related matters. We may ask for your consent to some of the matters in this Notice. This Notice explains how you may consent to them.

 

Definitions

When we use the terms below, we mean them to have the following meanings:

 

CCTV                                              Closed circuit television.

Company                                      Zantalite Enterprise(M) Sdn. Bhd. and its related companies.

Malaysia                                        Federation of Malaysia.

Our Business Associates              Our supplier, contractor, sub-contractor or whoever has any type of business dealing with us, whether past, current or intended

Our Customer                               Our customer whether past, current or intended

PDPA                                             Personal Data Protection Act 2010 of Malaysia.

Personal Data                               Information about yourself (where applicable, this includes information which relates to other persons who may be identified from information about yourself) which is “personal data” as defined by Section 4 of PDPA.

When we refer to a written law in this Notice, we mean to include, any amendments, modifications or substitution to it and any subsidiary legislation, guidelines, regulations and similar things made under or in relation to such written law.

 

Where we collect Personal Data​​

Where you are Our Customer and/or Our Business Associates, we may collect Personal Data when you communicate or register with us to become our customer and/or business associates.  We may collect more Personal Data in the course of our business relationship with you.

 

We may maintain various surveillance systems to monitor and/or record electronic and other communications which involve us.  We do this to protect the security and integrity of our operations and for crime prevention. Personal Data may be collected by such surveillance systems. We maintain too, in our offices, CCTV and other security surveillance systems.  If you choose to visit any of our offices, our security surveillance systems may collect Personal Data. Your images and actions, may, for example, be recorded by our CCTV surveillance systems.

 

We maintain a website or websites which give information about ourselves. You may also, as our customer or business associate, be given access to certain parts of our website or websites, not normally accessible by members of the public. You may anyhow, visit our website or websites as a member of the public. We may collect Personal Data when you visit our website (whether this is the part normally accessible by members of the public or not). 

 

What sort of Personal Data we collect​

We may collect a variety of Personal Data. These may include, the details of any person referring you to us, details of any contract or other arrangement which you may have with us, your name, photograph and/or other images, sound recordings, age, identity card, passport or other identification document numbers and details, address, gender, race and/or ethnic origin, nationality, current and savings account number, credit card details, bank name and other pertinent banking information, tax file identification number, EPF number, SOSCO number, date of birth, details of your spouse and/or your marital or other relationship, children or other family members or persons with whom you may be in a relationship, occupation, financial information (including financing arrangements), assets, qualifications, work experience, employment information, employer, income information, telephone, electronic mail and other means of communication. We may collect other Personal Data too.

What we do with the Personal Data we collect​

We collect, use and process Personal Data in a variety of circumstances for the following purposes:

  • To prepare the relevant agreements, contracts, legal documentation or forms or any other applicable documents

  • To correspond with you or any other relevant person (this may be by letter, electronic mail, telephone call or any other way and may be with persons in any jurisdiction) in relation to your property transactions (including but not limited to sub-sale and auction transactions), progressive claim, delivery of vacant possession, key handover, property/estate management, customer care, defect rectification works, post vacant possession services such as club house services, security and customer loyalty programmes, financing or refinancing, issuance of qualified/strata title, creation of lease, creation of sub-lease, transfer of titles, our business arrangement with you and/or any relevant matters (where applicable)

  • To carry out our administration and daily operation

  • To conduct credit checks and other backgrounds checks as we may determine to be necessary or appropriate

  • To send you newsletters or other materials to inform you of our activities, events, new launch of housing projects, new developments or the new products of our Company or other matters which we think may interest you (including, social events)

  • To use your name, photographs, videos or other records made or taken at or in relation to our activities or events (including, those which involve us) to which you may be invited or permitted to attend by us in our annual report or other promotional materials

  • To transfer or share of Personal Data within our Company and its related companies

  • To effect the collection of outstanding payment or debt or to make payment

  • To effect procedures or practices to prevent or mitigate crime or to maintain the security, integrity or good governance of our operations

  • To maintain our books and records (these may be kept in any media, and include, paper and electronic) for the purpose of reviewed or audited by independent professionals for compliance, security, integrity and/or good governance purposes (including, auditors (accounting firms) and independent anti-money laundering procedure auditors)

  • To carry out statistical or other analysis in relation to our operations and its needs

  • To provide information when we are involved in any litigation or other proceeding

  • To transfer your Personal Data (these may be in electronic, paper or other media) to our third party service or storage providers or contractors or sub-contractors (these may be in any jurisdiction) for purposes of data storage, back up or processing

  • To provide your Personal Data to our third party service providers, agents, contractors or management companies for the purpose of rendering services to you directly

  • To meet any requirements of laws or regulations or court order or direction, guideline, practice note, circular, code or other requirement of any governmental, public or regulatory authority or stock exchange (these include, any imposed on us by or from any jurisdiction outside Malaysia)

 

Apart from Malaysia, our collection, use and processing of Personal Data (including any disclosure) may be in, to, or from any jurisdiction outside Malaysia.  We may continue to collect, use and process Personal Data even after you are no longer our current customer or business associate.​​

What happens if you do not give us Personal Data or we cannot collect, use or process it

If any of these things happen:

  • We may not be able to accept or retain you as a customer and/or a business associate as it could adversely affect our operations and/or obligations

  • We will not be able to send you newsletters or other materials to inform you of our activities, events, new launch of housing projects, new developments or the new products of our Group or other matters which we think may interest you unless you have already consented to this

  • We will not be able to use your Personal Data for marketing or publicity purposes, unless you have already consented to this

 

Who we disclose to

We generally keep Personal Data confidential. However, we may disclose them in certain circumstances. These include the circumstances in What we do with thePersonal Data we collect above.  We may also, give or disclose your Personal Data, anyhow to:

  • Any of the persons whom or in circumstances which we refer to in What we do with the Personal Data we collect, above

  • Any governmental, public or regulatory authority or stock exchange in any jurisdiction when required by such authority or under law or regulation of any jurisdiction which applies to us

  • Any persons you consent to under our business agreement with you

  • Our auditors, independent anti-money laundering auditors, lawyers  and other financial or professional advisers

  • Our third party service, product or storage providers, contractors, sub-contractors, agent

 

We may give or disclose to any of them even if they are outside Malaysia and even if you are no longer our current customer or business associate.

Security

We are required by PDPA, when processing Personal Data, to take certain practical steps to protect Personal Data from any loss, misuse, modification, unauthorized or accidental access or disclosure, alteration or destruction.

 

You have certain rights to access and correct your Personal Data

You have certain rights in relation to Personal Data held by us. You may:

  • Ask us to tell you whether we hold or use Personal Data and ask to access it

  • Ask us to correct any Personal Data which is not accurate, complete or up-to-date

  • Ask us to retain Personal Data for only as long as is necessary to fulfill the purpose for which we collected it

  • Ask that we specify or explain our policies and procedures in relation to Personal Data and the types of Personal Data we handle

  • Object to the use of Personal Data for newsletters or other materials to inform you of our activities, events, new launch of housing projects, new developments or the new products of our Group or other matters which we think may interest you or for marketing of publicity purposes

  • Withdraw, wholly or partly any consent you provided previously subject to a reasonable time period

 

Your rights above in You have certain rights to access and correct your Personal Data may be restricted. You may have entered into contractual arrangements which limit your rights or your rights may be limited by law or regulation or the particular circumstances.

 

Consent

If you give or continue to give Personal Data to us, you will be deemed to consent to your Personal Data being collected, held or processed in the way specified in this Notice and in any other notice issued under Section 7 of PDPA by us.

 

We ask that you return any expressed consent to us within 14 days from the date of this Notice to assist us in the administration of these matters.  If we do not hear from you within the stipulated time, we will process your Personal Data in accordance with this Notice without further notice until we receive your instruction not to process or limit the process of your Personal Data.

 

You may also be regarded as giving your consent by your particular act or conduct in certain circumstances.

 

You should know that if you do not give your consent (whether by giving Personal Data by expressed consent or in any other way), we may still be authorised or required by applicable laws or regulations or by certain circumstances to disclose or give Personal Data.  Your consent will remain in effect regardless of any change in your relationship with us, for example, if you are a current customer or business associate, that you cease to be one.
